Facts
Illinois (plaintiff) filed a motion in the U.S. Supreme Court seeking permission to file a complaint against four cities in Wisconsin, including the City of Milwaukee’s (defendant) Sewerage Commission, and the Metropolitan Sewerage Commission of the County of Milwaukee for public nuisance stemming from pollution flowing into Lake Michigan, an interstate waterway. Illinois alleged that nearly 200 million gallons of raw or inadequately treated sewage and other waste was discharged daily into the Lake from the Milwaukee area alone and asked the Court to abate the public nuisance.
