Facts
The petitioner (plaintiff) was a software development and consulting company. The petitioner sought to employ the beneficiary as a programmer analyst classified as a nonimmigrant worker in a specialty occupation under the Immigration and Nationality Act. The beneficiary had a bachelor’s degree in math, physics, and electronics, as well as a master’s degree in marketing management. Additionally, the beneficiary had three years of related work experience. The petitioner submitted for the record an academic-credential evaluation from the World Academic Research Center, which concluded that the beneficiary’s degrees were equivalent to a United States bachelor of business administration degree. The petitioner provided only a general description of the analyst’s proposed duties, stating that he would assist with current and future projects. According to the Administrative Appeals Office handbook, there was no universally accepted way to prepare for a job as a systems analyst. The director of the service center denied the petition. The petitioner appealed.
