Facts
The Fifth Circuit Court of Appeals established a rule in which the district courts in its jurisdiction were to conduct forum non conveniens analyses for maritime cases differently than for nonmaritime cases. After the Fifth Circuit established this rule, the United States Supreme Court released an opinion implicating the forum non conveniens doctrine. The Fifth Circuit considered whether its rule could survive the Supreme Court’s new decision.
