Facts
The government believed that Edward Cunnius (defendant) was selling counterfeit Microsoft programs. The government applied for a search warrant authorizing a search of Cunnius’s digital devices. The warrant request explained how the government planned to conduct the search, but it did not contain any promise to foreswear reliance on the plain-view doctrine, nor did it state that the government planned to use a filter team to make sure only relevant parts of digital devices were searched by law enforcement.
