Facts
The Central Nebraska Public Power and Irrigation District (Tri-County) (plaintiff) filed an application with the Department of Water Resources (DWR) seeking recognition of incidental water storage in a three-county area. The application alleged that a large amount of underground water had formed in the region because of seepage from Tri-County’s surface canal irrigation system. Numerous owners of lands overlying the water mound (Opposing Landowners) (defendant) objected to Application U-2. DWR found sufficient evidence to support the belief that Tri-County’s irrigation project had formed the underground water mound.
