Facts
On March 11, 1970, the state filed a complaint for delinquency against B.H., alleging that B.H. committed assault and battery on March 10, 1969. The defense filed a motion to dismiss the complaint, arguing that the one-year statute of limitations (SOL) for assault and battery barred the complaint. The state conceded that it filed the complaint after the SOL expired but argued that the SOL did not apply to delinquency matters.
