Facts
Attorney Blumenstyk made certain personal financial commitments, including planning a family vacation and his son’s Bar Mitzvah, in anticipation of a $100,000 disbursement from his parents’ trust. The disbursement was delayed, and Blumenstyk felt unable to discuss his finances with his parents or his wife. Instead of cancelling the vacation and the Bar Mitzvah or borrowing money to cover the expenses, Blumenstyk withdrew and used $85,000 in client funds from his trust account without the clients’ authorization. After he received the distribution from his parents’ trust, Blumenstyk repaid the trust account in full.
