Facts
Marcia Britt (debtor) embezzled almost $20,000 from her employer, David M. Landis, P.A. (DML) (creditor). Britt subsequently filed for bankruptcy under Chapter 13 of the Bankruptcy Code. DML objected to the confirmation of Britt’s proposed payment plan, arguing that the plan did not comply with Bankruptcy Code § 1325(a)(3) because Britt did not propose it in good faith. However, DML did not claim that Brittt inaccurately stated her debt or expenses or made any fraudulent misrepresentations in her proposed plan.
