Facts
Budge Manufacturing Co. Inc. (Budge) (plaintiff) filed a trademark application for a mark intended for use in association with a type of automobile seat covers. The mark featured the term “LOVEE LAMB,” but the seat covers were made entirely from synthetic materials. Finding the mark to be deceptive, the Trademark Trial and Appeal Board denied Budge’s application to register the mark. Budge appealed the decision.
