Facts
Burgess (plaintiff) had operated a legal brothel in Nevada since 1983. Burgess filed for chapter 11 bankruptcy in 1997. In 1998, the sheriff and county commissioner revoked Burgess’s brothel license. Burgess requested that the bankruptcy court overturn the attempt to revoke the brothel license, because it decreased the assets of the bankruptcy estate. The bankruptcy court denied Burgess’s request, holding that the license was not property of the estate but merely a personal privilege. Burgess appealed.
