Facts
Canadian Pacific Limited filed applications to register the service marks “Canadian Pacific Enterprises Limited, Les Enterprises Canadien Pacifique Limitee” in connection with its Shareholder Dividend Reinvestment and Share Purchase Plan. The trademark examiner refused registration on the ground that the applicant was not performing a service within the meaning of Section 45 of the Lanham Act. The Trademark Trial and Appeal Board affirmed the examiner’s refusal, and Canadian Pacific appealed.
