Facts

Fourteen Employee Retirement Income Security Act (ERISA) actions were filed against Cardinal Health, Inc. (Cardinal) on behalf of the Cardinal Health Profit Sharing, Retirement and Savings Plan (Cardinal Plan) and the Syncor International Corporation Employees’ Savings and Stock Ownership Plan (Syncor Plan) (defendants). The actions were consolidated, and five plaintiffs moved to appoint lead counsel. Each plaintiff proposed a different law firm or group of law firms to serve in the role. The McKeehan plaintiffs proposed two law firms to serve as co-lead counsel, each of which had served as lead or co-lead counsel on a number of large ERISA actions. The two firms had successfully worked together in the past and had worked to identify and investigate potential claims for the current lawsuit, submitting a number of briefs. Each of the other plaintiffs proposed law firms with varying levels of complex-litigation experience. However, none of the proposed firms had extensive ERISA-litigation experience.
