Facts
Albert Carletti (plaintiff) constructed a gasket for use in sealing gasoline drums. Carletti then applied for a design patent. Carletti’s basis for the claim was that the ridges on the gasket were equally spaced concentric circles and were therefore aesthetically pleasing. The patent examiner rejected the application on the ground that the design was for functional purposes and therefore could not be registered as a design patent. The Patent Office Board of Appeals affirmed the decision. Carletti appealed to the United States Court of Customs and Patent Appeals.
