Facts
Jill Chambers (plaintiff) filed for Chapter 13 bankruptcy in 2010. Chambers was running for re-election for public office at the time. A garnishment order from Miami Circle, LLC (Miami Circle) had frozen Chambers’s bank accounts, including a campaign-fund account. The campaign account was not incorporated. Chambers’s Chapter 13 bankruptcy petition was an attempt to protect her campaign account from Miami Circle. The bankruptcy court held a hearing and ordered for the campaign account to be placed in trust by a Chapter 13 trustee. Another hearing was held to determine whether the campaign funds were the property of the bankruptcy estate.
