Facts
On January 27, 1987, the Youngstown Police Department (the department) received notices of illness from 16 of 17 police officers on the C turn and 12 of 16 officers on the B turn. The next day, the department received notices of illness from three officers on the C turn and two officers on the B turn. The officers all gave various reasons for their alleged illnesses. There was no evidence that the officers’ union, Lodge #28 of the Fraternal Order of Police (the union), had instigated or otherwise encouraged the officers to collectively give notices of illness to the department. The Ohio State Employment Relations Board (SERB) considered whether the officers had engaged in illegal conduct.
