Facts
Shell Oil Company (SOC), the record/former owner of the vessel EBII, and Shell Offshore, Inc. (SOI), the actual owner of the EBII, brought a limitation action as the owners of the EBII within the meaning of the term in the Limitation of Liability Act. A short time earlier, the EBII caught fire, resulting in the injury and death of several crewmen. Potential claimants admitted that SOI was the owner of the EBII but argued that SOC had no standing to bring a limitation action as it was not an owner under the act.
