Facts
Claire Conroy is in an incompetent state, unable to express whether she would cease or continue life-sustaining treatment. Her condition requires feedings via a naso-gastric tube for substantive nutrition. Her guardian nephew sought permission to remove the tube which would in effect end Conroy’s life. The trial court granted permission, which was appealed by Conroy’s guardian ad litem. Although Conroy subsequently died, the superior court granted review regarding the meritorious issues and held that a guardian could not decide to withhold nourishment from his ward in the absence of brain death, permanent vegetative state or imminent death. Plaintiff/guardian appealed.
