Facts
Container Applications International, Inc. (Container) (plaintiff) leased cargo containers to Lykes Bros. Steamship Co., Inc. (Lykes) (defendant) for use in Lykes’s shipping business. The containers were leased in bulk, and Lykes could use them on any vessel it chose. Lykes filed for bankruptcy, and Container sued to place maritime liens on Lykes’s vessels under the Federal Maritime Lien Act. The act provided that “a person providing necessaries to a vessel” could enforce a lien. Lykes responded that maritime liens could be asserted under the act only if the containers were provided directly to a vessel or were earmarked for a specific vessel. Here, no container was specified for any particular vessel. The bankruptcy and district courts ruled in Lykes’s favor, and Container appealed.
