Facts
On June 23, 1988, 13-year-old Michael Corcoran (defendant) went to a local pet store with a friend. While in the store, Corcoran’s friend asked Corcoran if he should put super glue on the back of a gerbil in an aquarium. Corcoran indicated that it did not matter to him, and the friend put super glue on the back of the gerbil. After an employee discovered the glue and contacted police, the police located and questioned Corcoran and his friend. A complaint was filed on July 22, 1988, charging Corcoran with delinquency for violating a criminal mischief statute because of the incident. A hearing scheduled for September 19, 1988, was rescheduled for November 14, 1988, due to the unavailability of a witness, and then continued again for December 28, 1988, for good cause shown. Following a hearing on December 28, 1988, Corcoran was adjudicated delinquent. Corcoran later appealed the judgment of the juvenile court.
