Facts
Angela Silveri and others (plaintiffs) brought suit against Boehringer Ingelheim Pharmaceuticals, Inc., Boyle & Co., and several additional companies (manufacturers) (defendants) for injuries they suffered due to in utero exposure to diethylstilbestrol (DES), a synthetic estrogen that was widely manufactured and distributed throughout the United States in the 1950s and 1960s. Approximately half of the plaintiffs were residents of New York when suit was filed, and their mothers were presumed to be residents of New York when they ingested the DES that harmed the plaintiffs. The manufacturers were companies or successors of companies that operated plants that manufactured DES throughout the country, largely outside of New York. Some of the manufacturers were incorporated outside of New York and claimed to have never obtained licenses to do business in New York.
