In re DG, Juvenile
Vermont Supreme Court
2003 WL 25746107 (2003)

- Written by Sara Rhee, JD
Facts
DG, a minor, used a lighter to ignite an aerosol spray from a deodorant can near two boys playing video games. One of the boys felt the heat of the flame but ignored it. The other boy felt the heat and told DG to stop, but the boy continued to play his game. A delinquency petition was filed against DG on the ground that he recklessly placed others in danger of death or serious bodily injury. At an evidentiary hearing, DG testified that he did not think he would hurt anybody and was unaware that the can could explode. The Washington Family Court found DG to be delinquent. DG appealed.
