Facts
Di Joseph (defendant) was charged with murder. The law of the state of Pennsylvania (plaintiff) vested the trial court with discretion to determine whether a criminal defendant should be allowed to inspect physical evidence before trial. Upon Di Joseph’s motion, the trial court ordered the prosecution to permit inspection of certain items of evidence. The prosecution appealed and the appellate court affirmed the trial court’s order. The prosecution petitioned the state supreme court for review.
