Facts
Eastern National (plaintiff) applied to register “Independence Park Institute” as a trademark on June 16, 1998 for a number of products and marketing. The examining attorney found that the mark was merely descriptive of Eastern National’s goods and services and denied the application. Eastern National then appealed to the Trademark Trial and Appeals Board (TTAB).
