Facts
Ellery C. (defendant) was a 16-year-old juvenile adjudicated as a person in need of supervision (PINS). After a year, a family court placed Ellery in a state training school with juvenile delinquents based on the probation department’s recommendation. The state claimed that although the training school was not ideal, it was the only facility with availability that could help Ellery develop into an upstanding member of society. However, the record did not support this assertion. On appeal, an appellate court affirmed the disposition. The case came before the New York Court of Appeals.
