Facts
Sam McCullum (plaintiff) was a wide receiver for the National Football League’s Seattle Seahawks (defendant). McCullum was the Seahawks’ player representative in the players’ union, the National Football League Players Association (NFLPA) (plaintiff). The Seahawks released McCullum from the team. McCullum and the NFLPA filed an unfair-labor-practice claim under the National Labor Relations Act (the act) against the Seahawks with the National Labor Relations Board (NLRB). McCullum asserted that his actions as a player representative led to his release. The matter was referred to an administrative-law judge (ALJ). The Seahawks claimed that McCullum was released because they wanted better players. McCullum testified that Seahawks employees had warned him about the risk of being the player representative.
