Facts
Eight independent companies, including EMC Corporation (defendants), were sued by Oasis Research LLC (plaintiff) for patent infringement as part of a single complaint in the United States District Court for Eastern District of Texas. The companies filed a motion to sever the claims and transfer them to more appropriate venues. The companies argued that the claims were improperly filed in a single complaint because the claims did not arise out of a single transaction or occurrence. The magistrate court found that the claims did arise out of a single transaction or occurrence because the allegedly infringing services offered by the companies were not dramatically different from each other. The magistrate court’s conclusions were affirmed by the district court. The companies petitioned for a writ of mandamus.
