Facts
In January 1982, Harry Wayne Conley executed a will leaving his entire estate to his sister, Margaret York (plaintiff). Conley kept the original will in a filing box at his home, and the attorney who drafted the will kept a conformed copy of it at his office. After Conley’s death in 2001, his original will could not be found. Conley’s nephews, Albert Conley and Colin Conley (the nephews) (defendants) petitioned to probate Conley’s estate by intestacy. York petitioned to probate the conformed copy of Conley’s will. The trial court granted York’s petition, and the nephews appealed.
