Facts
Edward Laura had three children: Edward Jr., Shirley (defendant), and Jo Ann. Jo Ann had two sons, Richard and Neil. Jo Ann died. Ten years later, Edward Sr. executed a will leaving his entire estate to Shirley. The will expressly disinherited Edward Jr., Richard, and Neil. Neil had two children, Cecilia and Neil III (plaintiffs). The will did not name Cecilia or Neil III. Neil III and Cecilia’s father, Neil, predeceased Edward Sr., and after Edward Sr. died, Shirley admitted his will to probate. Cecilia and Neil III sued for their intestate share of the estate as pretermitted heirs of Edward Sr. The trial court ruled against Cecilia and Neil III, and they appealed.
