Facts
The will of Ruth Parker, decedent, was lost. The estate of Ruth Parker (plaintiff) submitted a draft copy of the will for probate, claiming it was a correct and accurate copy of the lost will. The circuit court held that the draft copy was not a proper correct copy. The estate appealed, and the district court reversed, finding the draft was a correct copy of the lost will and was therefore sufficient to establish the terms of the lost will for probate. The district court then raised the question of whether a draft could count as a correct copy of a lost will to the Florida Supreme Court as a certified question.
