Facts
Russell Shannon executed a will leaving everything to his daughter, Beatrice Saleski (defendant), and expressly omitting any unnamed heir and disinheriting any challengers to the will’s validity. A decade later, Russell married Lila Shannon (plaintiff) but did not change his will. Russell died two years later, and his will was admitted to probate. Lila petitioned for her share of the estate as a pretermitted spouse. The trial court denied Lila’s petition. Lila appealed.
