Facts
Ford Motor Company (Ford) (defendant) equipped each of its E-350 vans with 15 seats. Ford advertised the vehicle as a “15-passenger” vehicle, “very safe,” and “America’s most trustworthy” van. In fact, the E-350’s defective design gave the van a high center of gravity that made the E-350 unusually prone to rollovers. Consumers (plaintiffs) brought a class-action lawsuit against Ford for misrepresenting, as suitable, a van that was unsafe and therefore unsuitable for transporting 15 passengers. Ford defended its E-350 advertising as an example of nonactionable puffing and moved to dismiss the case.
