Facts
Two patent applications filed by Gerard were involved in an interference dispute with J. Oppenheimer. Oppenheimer’s application matured into a patent, and Gerard’s applications were abandoned. A petition was filed requesting access to the Gerard applications to resolve an issue of possible infringement in connection with the Oppenheimer patent.
