California Supreme Court
1 Cal. 3d 855, 83 Cal. Rptr. 671, 464 P.2d 127 (1970)
- Written by Mary Katherine Cunningham, JD
Facts
When Gladys R. (defendant) was 12 years old, a juvenile court considered whether to declare her a ward of the state. Before a jurisdictional hearing, the juvenile court reviewed a social-study report; the juvenile court also considered the fact that Gladys R. had the mental and social age of a seven-year-old. The juvenile court subsequently declared Gladys R. a ward of the court and permitted a probation officer to place Gladys R. in a private institution. Gladys R. then appealed the juvenile-court decision, arguing the court erred by applying Section 602 of the Welfare and Institutions Code.
