Facts
A Place For Us, Incorporated (APFU) was sued civilly by a number of medical-insurance companies for alleged fraudulent billing in excess of $100 million. The parties settled after extensive discovery and before trial. The district court granted a protective order covering the discovery that had occurred prior to settlement. A grand jury that was criminally investigating APFU subpoenaed Meserve, Mumper & Hughes (MMH), a law firm for one of the insurance companies, seeking all of the documents that were produced during discovery of the civil suit. APFU filed a motion to intervene, which the district court granted. APFU also filed a motion to quash the subpoena and enforce the original terms of the protective order, which the district court denied. APFU appealed to the United States Court of Appeals for the Ninth Circuit.
