Facts
Phillip and Judy Greer (debtors) filed a joint case under Chapter 13 of the Bankruptcy Code (code). The Greers proposed paying their creditors $707.43 per month for 36 months. All of the Greers’ payment proceeds would go to their secured and priority creditors and to pay the Chapter 13 trustee’s fees. The unsecured creditors would receive nothing. In support of the plan, the Greers showed that the unsecured creditors would receive no repayment in a Chapter 7 liquidation. The trustee objected to the plan, contending that the Greers should pay more per month and that the plan should extend beyond 36 months to enable some payment to the unsecured creditors.
