Facts
Hall (plaintiff) was a native and citizen of Guyana. Hall came to the United States to attend a rally sponsored by the Unification Church held at Yankee Stadium in New York. After the rally, Hall went to Puerto Rico, where he became a missionary for the Unification Church. As a missionary, Hall had duties that included witnessing, teaching people on the street and in seminars, handing out literature, visiting churches, helping people financially, and raising money for the church. To raise money for the church, Hall sold toys, jewelry, and other trinkets. Hall gave the full proceeds from his sales to the church, which, in turn, provided Hall with housing, food, clothing, medical expenses, transportation, entertainment, and other personal expenses, as well as $25 per month. An immigration judge determined that Hall was an overstayed immigrant and not eligible for adjustment of status because of the unauthorized-employment bar. Hall was granted the privilege of voluntary departure in lieu of deportation. Hall appealed the immigration judge’s decision regarding his eligibility for status adjustment.
