Facts
Elaine Hanson (plaintiff) was an adoptee who wished to establish that she had Native American heritage. If Hanson could prove such heritage, she would be entitled to a state tuition waiver and other benefits. Hanson petitioned a probate court to make her adoption records available for her inspection. The probate court denied Hanson’s petition, holding that she did not show good cause under the Indian Child Welfare Act (ICWA) for the court to release her records to her. Hanson appealed.
