Facts
Ibrahim (plaintiff) was a native and citizen of Lebanon who entered the United States as a nonimmigrant visitor for pleasure. Ibrahim later filed an application for adjustment of status based upon a fifth-preference visa petition filed by his sister. The district director and an immigration judge denied the application on the basis that Ibrahim entered the United States with the preconceived intention of remaining. Ibrahim appealed.
