Facts
Innovatio IP Ventures, LLC (Innovatio) (plaintiff) owned several standard-essential patents relating to wireless internet service. This meant that Innovatio’s patented technology was required for other internet-service providers to comply with wireless standards set by the Institute of Electrical and Electronics Engineers. Innovatio sued several coffee shops, retailers, and other businesses for patent infringement. Innovatio alleged that these companies infringed Innovatio’s standard-essential patents while providing internet service to their customers. Innovatio also sued several manufacturers of electronic devices used to connect to the internet, like routers. Innovatio’s suits were consolidated into one multidistrict litigation. The parties agreed that after discovery but before a liability determination, they would pause the proceedings to allow the court to assess damages as an avenue to discussing settlement. After hearing evidence, the court ruled on the appropriate royalty rate the infringing device manufacturers should have paid.
