Facts
Theodore Roosevelt Johnson Sr. (plaintiff) filed for bankruptcy and included a 1969 Dodge bus on his list of property exemptions. The bus was used to transport church members from Johnson’s congregation and could hold up to 60 people. The bankruptcy trustee disagreed with Johnson that the bus should be exempted, arguing that the bus was not an automobile and that the applicable state statute exempting motor vehicles only applied to automobiles. The trustee objected to the exemption of Johnson’s bus.
