Facts
Attorney Lynnel Jones (debtor) filed for bankruptcy when she was unemployed with a husband on disability and three children, but she found a new job after filing. Jones’s Chapter 13 statement listed the couple’s combined income at $4,324 per month and expenses of $4,178 per month, leaving only $146 disposable monthly income to pay creditors. Her expenses included $500 a month for her son’s college tuition, $500 a month for another child’s secondary-school tuition, a $989 house payment, and $515 for food. An unsecured creditor (creditor) objected to the plan solely on the ground that the tuition payments were not reasonably necessary.
