Facts
John and James LaRue were born to Joanne LaRue (defendant) on January 2, 1971. In July 1971, Joanne entered into an entrustment agreement with the county welfare service (CWS) (plaintiff), voluntarily placing John and James into CWS’s custody. CWS placed John and James with foster parents that fall. In January 1975, Joanne notified CWS that she wanted custody of John and James, ending her assent to the agreement. In an effort to continue the foster parents’ custody, CWS filed a petition alleging that John and James were deprived of proper parental care or control within the meaning of Pennsylvania statute. The trial court found that John and James were not deprived of proper parental care or control because they were doing well in a good home. The court ordered John and James to remain with the foster family and continued the matter for six months. LaRue appealed.
