Facts
Paolo Longi and others (the inventors) applied for a patent on certain catalysts used for polymerizing ethylene. The application was assigned to an Italian company that owned three other polymerization-catalyst patent applications. The United States Patent and Trademark Office (PTO) examiner rejected the application on double-patenting grounds because the three other applications covered the same subject matter. The PTO board of appeals affirmed. The inventors appealed to the United States Court of Appeals for the Federal Circuit, arguing that the patent applications lacked overlapping claims.
