Facts
Pamela (plaintiff) and Roger (defendant) Allen were divorced. As part of the divorce settlement, Pamela was given money and property that she then used to buy a house in Florida. Roger’s employer, United Mortgage Company (UMC), discovered that Roger had embezzled a significant amount of funds and that those funds had been involved in the divorce settlement. UMC moved to intervene in the divorce settlement to retrieve the stolen funds. The trial court ruled against UMC, and UMC appealed to the court of appeals. The court of appeals reversed, finding that UMC was entitled to an equitable interest in the property. Pamela appealed to the Colorado Supreme Court.
