Facts
A trial court granted Mark Yockers (plaintiff) a divorce from his wife, Claudine Dombrowski (defendant). The court retained jurisdiction over the issue of Yockers’s missing guns. The court subpoenaed Bill Miller, who, under questioning, admitted to having obtained the guns from Dombrowski. The court also subpoenaed Miller to appear and testify at hearings on Yockers’s replevin motion to recover the guns. The court rejected Miller’s assertion that he was entitled to keep the guns as a bona fide purchaser. Instead, the court ordered Miller to return the guns to Yockers. Miller’s lawyer promptly and successfully moved the court to set aside its order for lack of personal jurisdiction over Miller. On appeal to the Kansas Court of Appeals, Yockers argued that Miller’s jurisdictional challenge was untimely and precluded by Miller’s involvement in the case.
