Facts
Robert Buonano purchased the residence of Peter Medaglia (debtor) at a foreclosure auction on September 9, 2008. A memorandum of sale was executed that day, and Buonano paid the required deposit. On September 11, before Buonano recorded his deed to the property, Medaglia filed for Chapter 13 bankruptcy. Subsequently, Buonano filed a motion for relief from the automatic stay in order to record a deed and to take possession.
