Facts
Minei (plaintiff) was a native and citizen of Italy who entered the United States as a visitor for pleasure. One month later, Minei filed a petition for a change in status to a visitor for business. Minei stated that his sole purpose for visiting the United States was to paint the scenery of New York and to show and sell his paintings at various galleries in Florida, New York, and California. The district director denied Minei’s application for change of status. Minei appealed the decision.
