Facts
Jean-Pierre Klifa owned Miracle Tuesday, LLC (plaintiff). Klifa lived and worked in Paris for 22 years before moving out of the city. Miracle was based in Miami. Miracle applied to register the trademark JPK PARIS 75 and design, for fashion accessories such as belts and handbags. The design consisted of “JPK” in large font above the words “PARIS 75.” The company’s fashion accessories were not designed or made in Paris. The Trademark Trial and Appeal Board found that the mark was primarily geographically deceptively misdescriptive and thus not registrable. Miracle filed suit appealing the ruling, arguing, among other things, that Klifa had a significant connection with Paris.
