Facts
MLK (child) was born in Colorado and was immediately placed with foster parents (plaintiffs) who later moved to Kansas. Several years after moving to Kansas, the foster parents filed a motion in Kansas state court to terminate the parental rights of the child’s biological parents (defendants). The child’s biological father was unknown, and the child’s biological mother could not be found. Therefore, the trial court permitted the biological parents to be served by publication and subsequently terminated their parental rights. Counsel appointed to represent the child’s absent biological parents appealed the trial court’s judgment.
