Facts
Plaintiffs filed a class-action lawsuit against Ford (defendant) for breach of express warranties relating to a defective infotainment system contained in Ford’s automobiles. Ford moved to dismiss the complaints of certain plaintiffs, namely, Ms. Battle (Alabama), Mr. Sheerin (Colorado), Mr. Zuchowski (Ohio), and Mr. D’Aguanno (Arizona), arguing that each failed to allege satisfaction of the notice requirement under Uniform Commercial Code (UCC) 2-607(3)(a).
